Central Adoption Authority: Institut du Bien Social et de Recherches (IBESR)

Family Requirements

  • Age: The adoptive parent must be at least 19 years older than the child they intend to adopt. These restrictions can be waived with permission from the President of Haiti. For married couples, one prospective adoptive parent may be under age 35, provided the couple has been married for ten years and has no biological children. Also, under Haitian law, the prospective adoptive parent (married couples or single females) must be 35 or older.
  • Marriage: Adoptions by married couples require the consent of both spouses. This restriction can be waived with permission from the President of Haiti.
  • Household: No more than 3 biological children in the home for Married couples. No more than 2 biological children in the home for single females.

Country Information

  • Residency & Travel Requirements: Haitian law does not require prospective adoptive parents to reside in Haiti, although Haitian courts and/or the Institut du Bien Etre Social et de Recherches (IBESR, the Haitian adoption authority) may require American prospective adoptive parents to travel to Haiti before the adoption is finalized. The U.S. Government does not require adoptive parents to travel to Haiti at any time during the adoption and immigrant visa process. Both adoptive parents are required to travel at least once.
  • Wait Time: An adoption will take up to 2 years; each case can vary.

Children Available 

  • Age of Children: 6 months and up.
  • Special Needs: Children abandoned or orphaned before the earthquake or relinquished by surviving birth parents after the earthquake are available for adoption.
